In this privacy statement (the "Privacy Policy"), we describe how ReviewXpo (the "Company", "our", "us" or "we") uses and protects information collected from visitors to ReviewXpo.com, other websites and apps owned and operated by the Company that redirect to ReviewXpo, and all subdomains of ReviewXpo (collectively, the "ReviewXpo Site" and "ReviewXpo App"), our clients ("Clients"), our clients' customers ("Customers") and other users ("Users") of the ReviewXpo Properties (as defined below).

This Privacy Policy applies to information collected by the Company through the ReviewXpo Site, ReviewXpo App, any Company computer software downloaded or otherwise available from the ReviewXpo Site ("ReviewXpo Software"), and any Company services purchased or otherwise made available from the ReviewXpo Site ("ReviewXpo Services") (collectively, the "ReviewXpo Properties").

Third Party Services (collectively, "Third Party Services") are not covered by this Privacy Policy. Information viewed or provided to Third Party Services accessed via the ReviewXpo Properties is not covered by this Privacy Policy. In addition, we cannot be held responsible for the content or privacy policies of Third Party Services. We encourage you to carefully review the privacy policies of any integrated platforms or Third Party Services you may access via the ReviewXpo Properties if you are a Customer.

In addition, this Privacy Policy does not cover information recorded in any form about more than one individual whose identities are not known or cannot be inferred from the information ("Aggregated Information"). It is the Company's right to use Aggregated Information in any way it deems appropriate.

Whenever you use a Service or provide us with your Personal Information, you agree to the practices described in this Privacy Policy, as amended by us from time to time, and to the collection and use of your information in accordance with this Privacy Policy. In the event that you are not comfortable with the collection, use, and disclosure of your information in this way, please do not use any ReviewXpo Properties or provide the Company with Personal Information (as defined below).

We reserve the right to modify or replace the Privacy Policy at any time. You can find the most recent version of the Privacy Policy at https://www.reviewxpo.com/privacy-policy. If we make any material changes to the Privacy Policy that, in our sole discretion, materially impact your use of the ReviewXpo Properties or the treatment of your Personal Information, we will notify you via email or another direct electronic communication method. Please check the Privacy Policy periodically for changes. Following the posting of any changes to the Privacy Policy, your use of the ReviewXpo Properties constitutes acceptance of those changes.

In order to provide you with products and services, the Company collects only the information it needs. Depending on the circumstances, the amount of information you provide and the amount collected by the Company may vary. You may provide the Company with two (2) types of information: personal and non-personal.

Any information about a living individual (e.g. name, mailing address, telephone number, and e-mail address), or whose identity can be inferred or determined from the information, is regarded as personal information. You may provide the Company with Personal Information when you use the ReviewXpo Properties, including, without limitation, when you create an account, fill out surveys, or correspond with the Company.

Information that does not identify you as an individual (e.g. demographic information or website visits) is called non-personal information. Non-Personal Information may be collected using any of the methods discussed above or automatically through the use of industry standard technologies described below.

In order to create an account ("Account") or to enable features or functionality of the ReviewXpo Properties, the Company may require you to provide us with certain Personal Information and Non-Personal Information.

When it comes to Clients, the Company may collect Personal Information about organizational representatives through various methods (phone, e-mail, online forms, in-person meetings) but only if such Personal Information is voluntarily submitted. ReviewXpo Properties may use such Personal Information for sales, marketing, and customer support. The Personal Information collected by ReviewXpo is never disclosed to third parties other than Third Party Service Providers used by a Client.

Whenever you send us email or other communications, we may retain those communications in order to process your inquiries, respond to your requests, and improve the ReviewXpo Properties.

You may automatically provide information to the Company by using your computer or mobile device, such as information about your activities on the ReviewXpo Properties, the type of hardware and software you are using (for example, your operating system or browser), and information from cookies (see below). In order to better understand your and the needs of Users in the aggregate, we may link this Non-Personal Information to your Account. This allows us to diagnose problems, analyze trends, provide services, improve the features and usability of the ReviewXpo Properties, and better understand and market to our clients and users.

The following methods are used to gather information automatically using technology:

The ReviewXpo Site and other ReviewXpo Properties might use cookies. Cookies, including local shared objects, are small bits of data that your browser stores on your computer's hard drive. They work by assigning to your computer a unique number that does not have any meaning outside of the ReviewXpo Properties. In general, cookies do not contain any personal information. In most web browsers, cookies are automatically accepted, but you can usually configure your browser to prevent this. Certain ReviewXpo Properties features may not work if cookies are not accepted.

You can visit many areas of the ReviewXpo Site anonymously without registering. In such cases, the Company may still collect IP addresses automatically. Every time you sign up for Internet services, your computer is automatically assigned an IP address. Your IP address is logged each time you access the Site and request a page on the ReviewXpo Site.

Small pieces of data are embedded in web pages and emails called web beacons. These technical methods may be used by the Company in HTML emails it sends to Users to determine whether they have opened the emails and/or clicked on links within them. Through the use of these technical methods, personal information may be collected.

The Company tracks and captures Non-Personal Information associated with User accounts and the use of Content by those who access your Content if you use the ReviewXpo Services and post any materials, information, or intellectual property (collectively, "Content") to your website or to a third party website.

Non-Personal Information

You can rest assured that none of your Personal Information is sold, transferred, or otherwise disclosed to outside parties, except as set forth below. ReviewXpo Properties or our services are not included in this statement. We rely on trusted third parties to help us administer and provide these properties. Examples of these services include storing and managing Content, analyzing data, providing marketing assistance, integrating Third Party Services such as CRM and MAP, processing credit card payments, and providing customer service. The third party service providers will have access to Personal Information needed to perform their functions, but they cannot use it for any other purpose. Our service providers may be located outside of Canada, and your Personal Information may be processed and stored there and may be subject to the laws of those countries.

In order to prevent fraud and process payments, we may share Payment Information with third parties.

In addition to releasing information when required by law, enforcing our policies, or protecting our or others' rights, property or safety, we may also release your information if we believe it is appropriate to do so. Additionally, we may share Non-Personal Information with third parties for marketing, advertising, or other purposes.

Client, Customer, and other User information, including Personal Information, is considered a business asset. We may disclose or transfer your Personal Information to a third-party acquirer in connection with the transaction in the unlikely event that we go out of business, become bankrupt, or are acquired as a result of a merger, acquisition, or asset sale.

Furthermore, we may provide Clients with specific information regarding how their Content is viewed or accessed on ReviewXpo Properties. An example of such information would be the number and type of Content watched by a particular Customer of a particular Client, the location from which a particular Customer viewed or accessed the particular Content, and the number of times that particular Content was viewed or accessed. Furthermore, if you, as a Customer, provide Personal Information (such as your email address) to access and view Content, that Personal Information may be collected by us, a provider of Third Party Services or an integrated platform on behalf of the Client who owns the Content and shared with the Client or with Third Party Service providers, since we and others are their service providers. Clients will use such information in accordance with their information and privacy practices and policies, and the Company is not responsible or liable for their use of your information.

It is possible that the Company may have a legal duty or right to collect, use, or disclose your Personal Information without your knowledge or consent in certain exceptional circumstances. Consumer information (including Personal Information) will not be disclosed without your written consent in accordance with applicable laws, except where required by law: (i) for billing or market operation purposes; (ii) for law enforcement purposes; or (iii) to comply with a legal obligation.

By consenting to the above purposes, you consent to the disclosure of your information. Other than Clients, third parties with which your Personal Information may be shared may also be bound by appropriate confidentiality agreements with the Company and/or its Clients.

A variety of security measures are taken by the Company to protect Personal Information from unauthorized access, alteration, disclosure, or destruction. The Company conducts internal audits, including, but not limited to: (a) data collection; (b) data storage and processing practices; (c) electronic security measures; and (d) physical security measures to prevent unauthorized access to systems where Personal Information is stored.

It is unfortunately impossible to guarantee the security of data transmission over the Internet. Therefore, while we are committed to protecting your Personal Information, we cannot guarantee or warrant its security.

A breach of confidentiality by Company employees, contractors, or agents may result in termination, criminal prosecution, or disciplinary action.

Your Personal Information may be stored or processed on servers located outside your jurisdiction of residence, which may have different data protection laws than your jurisdiction of residence. In these jurisdictions, government, courts, and law enforcement may access this information according to their laws.

We are very concerned with the safety of children when they use the Internet. Only individuals of minimum age should access the ReviewXpo Properties. Depending on where the individual accesses the services, "Minimum Age" may mean different things in different countries. In the United States, Canada, Germany, Spain, Australia, and South Korea, the "Minimum Age" is 14 years old; in all other countries, it is 13 years old.

The Minimum Age would, however, be such an older age if applicable law requires that you be older than such ages to be allowed to use the ReviewXpo Properties (including the collection, storage, and use of your information in accordance with this Privacy Policy). Children and anyone under 13 are not permitted to use the ReviewXpo Properties.

There may be links on the ReviewXpo Properties to third party websites and services, including Third Party Services, which may collect personal and non-personal information directly from you. We provide links to third-party sources only as a convenience. There is no connection between the Company and Third Party Sources. Independent of the Company, Third Party Sources may have their own privacy policies and data collection practices. In addition, the Company: (a) has no responsibility or liability for these independent policies or actions; (b) does not guarantee the privacy practices or content of these websites; and (c) does not guarantee the security of any information you provide to such websites or the contents, products, or services offered on such websites.
